遗嘱什么情况下失效？

上周自掏腰包去听了新加坡保险学校举办的讲座， 专门邀请了律师来介绍遗嘱方面的专业知识， 我之前也简单写过一篇文章讲遗嘱：
#聊聊家庭资产配置之—新加坡立遗嘱
讲座先介绍了遗嘱的三步骤： 遗嘱计划， 遗嘱起草以及遗嘱见证。以及一份遗嘱法律有效需要的要求，律师的讲座非常枯燥，因为内容都是法律条文， 不过分享的案例倒是非常精彩， 都是新加坡历史上实际发生的案例，很有意思。

遗嘱自动失效的情况

1） 立遗嘱人结婚（或再婚）

在新加坡， 结婚后旧遗嘱自动失效，除非遗嘱中已明确说明。

2） 新加坡一般遗嘱执行需要去法庭申请遗嘱执行令(probate)， 如果法庭判定以下情况就会失效

比如：

—–遗嘱设立人没有签名；

—–没有两个见证人；

—–见证人没有同时签字遗嘱， 而是不同时间分开签的（实际案例有发生过，那么法庭怎么会知道的？）

—–遗嘱设立人不具备设立能力， 分享案例中有一位老人有10+孩子， 先后被家里不同的孩子带去设立遗嘱， 而且每份遗嘱的收益人都不同。而老人早年判定有老年痴呆。

3） 遗嘱被正式撤销

—- 立新遗嘱（新遗嘱中声明“撤销所有旧遗嘱”）；

—- 书面声明撤销；

—- 亲手销毁遗嘱（撕毁、烧毁等）

另外遗嘱也可能部分失效：

比如遗嘱中指定的受益人先于遗嘱人死亡；

遗嘱见证人同时是收益人， 那么见证人就不能享有分配的遗产， 这部分遗产会分给其他收益人。

需要注意的是：

离婚不会自动使遗嘱无效，所以离婚后需要重新设立遗嘱。

有人会问了：我不找律师， 或者财务规划师， 我自己从网上下载个版本可以吗？只要符合遗嘱有效的设立条件是没问题的， 不过遗嘱设立本身并不贵， 属于花小钱办大事， 为了避免遗嘱失效，还是推荐找专业人士做。
