没有遗嘱，家人如何继承资产？

1️. 资产被冻结 

  • 银行账户、房产、股票、保险等都会被冻结
  • 家人无法提款、卖房或处理资产
  • 需要法院批准后，才能获得资产管理权限

2️. 申请遗产管理书（Letters of Administration） 

  • 继承人需要找律师申请法院批准，成为遗产管理员（Administrator）
  • 申请人优先级（按照法律顺序）：
     配偶 →  子女 →  父母 →  兄弟姐妹 →  其他近亲

3️. 偿还债务 

  • 遗产管理员负责清点资产，并偿还逝者的银行贷款、信用卡、税务、医疗账单等

4️. 按照法律分配剩余资产 

  • 遗产必须严格按照《无遗嘱继承法》分配
